Magaya Trial:Followers ignore Prophet’s plea

Prophetic healing and deliverance ministries leader Walter Magaya’s followers yesterday defied his plea not to attend court as dozens thronged the Harare magistrates court following a hearing in which he is charged with rape.

 Dozens of PHD Minisries followers defied Magaya’s call not to attend to his matter as the packed the courtroom with some anxiously waiting outside the courts. The defying followers burst into praise songs as they mobbed him after the court proceedings. Magaya is standing accused of raping a 25-year-old congregant at his Mt Pleasant home.

The state led by Sebastian Mutizirwa told the magistrate Vakayi Chikwekwe that investigations into the rape allegations were completed on September 13 and the docket was now at the Prosecutor General’s office for perusal.

“We apply that the matter be postponed to September 29. The docket is now at the Prosecutor General’s office for perusal. Investigations are now complete. They were completed on September 13,” he said. Speaking through his lawyers, Admire Rubaya, Everson Chatambudza and Oliver Marwa, Magaya applied to have his reporting conditions at the police relaxed. He told the court that it was difficult for him to attend to his projects outside the capital.

“We consent to the remand on the understanding that the state gives a position on triable issues. We apply that the reporting conditions be relaxed from reporting three times a week to once a week reason being that the accused has a number of projects he embarked on which are spread all over the country. It is difficult for him to t ravel to Bulawayo and do business. Bail condition should not be penal in nature. Accused has shown that he can be trusted since he has been religiously reporting to police and there is no foul cry by the state that he had not been abiding,” said lawyer Rubaya.

Lawyer Rubaya also notified the state that they would make an application to have Magaya’s passport temporarily released to allow him to travel outside the country before his next remand date. Magistrate Chikwekwe relaxed Magaya’s reporting condition to once every Friday before remanding him to September 28 for his routine remand. Magaya is out of custody on $2000 bail.
